Service Business Fined Under Ontario EPA

Terry Piontek, operator of Piontek Auto Centre, in Thomasburg, Ontario was fined $7,500 — plus victim fine surcharge — after pleading guilty to one count of failing to comply with a Section 190 Environmental Protection Act (EPA) Order made by a justice of the peace on July 6, 2004. The court heard that, on July 6, 2004, Mr. Piontek pleaded guilty to operating a waste disposal site for used tires without a Certificate of Approval. He was fined $2,500 and in addition an Order, pursuant to Section 190 of the EPA was issued by Justice of the Peace Rene J. Proulx, requiring the removal of all used tires from the site within 90 days.
In October 2004 a Provincial Officer for the Ministry observed that the tires had not been removed as required, and Terry Piontek was charged accordingly. On April 25, 2005, Terry Piontek pleaded guilty to one count of failing to comply with a Section 190 Order made under the EPA and was fined $7,500 plus victim fine surcharge.
In addition, the Justice of the Peace issued a new s. 190 Order requiring the defendant to remove all the used tires from the site within 180 days. Justice of the Peace Marilyn A. Robins heard the plea and sentencing submissions in the Ontario Court of Justice in Belleville, Ontario.
