The former owner of a Toronto repair garage has been fined $30,000, plus victim surcharges, for rigging emissions testing results.
Vartan Hofsep Mofssessyan has been fined after rigging Drive Clean test results and providing false information to an agent of the Ministry of the Environment.
Mofssessyan owned Anne Automotive at 151 Toryork Drive in Toronto, a formerly accredited Drive Clean test and repair facility.
The court heard that Mofssessyan falsified test results for three vehicles undergoing Drive Clean tests in July 2000. Mofssessyan was convicted and fined $5,000 for each of three counts under section 9 (13.1) of Regulation 361/98, made under the Environmental Protection Act (EPA), involving permitting the operation of a motor vehicle that does not comply with prescribed emissions standards.
Mofssessyan was also fined $5,000 for each of three counts under section 184(2) of the EPA, relating to submitting false or misleading information to an agent of the Ministry of the Environment.
Charges against an employee of Anne Automotive were dropped at the request of the Crown.
